On behalf of the Environmental Protection Agency and in coordination with the U.S. Attorney’s Office for the Northern District of Ohio, the Justice Department’s Environment and Natural Resources Division announced a complaint against Norfolk Southern related to the Feb. 3, derailment in East Palestine, Ohio. The complaint seeks penalties and injunctive relief "for the unlawful discharge of pollutants, oil, and hazardous substances under the Clean Water Act, and declaratory judgment on liability for past and future costs under the Comprehensive Environmental Response, Compensation, and Liability Act." The EPA and other federal agencies continue to investigate the circumstances leading up to and following the derailment, the agency said in a statement.
