U.S. District Judge Roy Altman rejected Burger King’s bid to dismiss a lawsuit alleging the chain cheated customers by making its Whopper burger seem larger than it is, Reuters’ Jonathan Stempel reports, citing the ruling. The judge said Burger King must defend against the proposed class action which claims depiction of Whoppers on in-store menus mislead reasonable consumers.
